OZtrail Terms and Conditions
These terms and conditions apply to your use of this Website and to all transactions that are processed through this Website, or are in any way transacted between Adventure Trading Australia Pty Ltd ABN 77 010 916 006 trading as OZtrail Leisure Products and You, an end consumer purchaser of Our products. These Terms are included and inserted to and will apply to your Order. Other terms may also apply to this Order.
1. About these Terms
1.1. These terms and conditions apply for all transactions that are processed through the Website, or are in any way transacted between Adventure Trading Australia Pty Ltd ABN 77 010 916 006 trading as OZtrail Leisure Products and You, an end consumer purchaser of Our products. These Terms are included and inserted to and will apply to your Order. Other terms may also apply to this Order.
1.2. You will be bound by these Terms for each and every Order processed via this Website and each occurrence will form a new agreement between You and Us.
1.3. By using our Website, You signify Your agreement to these Terms. As these Terms may be amended from time to time, please review this page regularly. Continued use of the Website after any amendments signifies acceptance of the changes. The Terms that apply to an Order are the Terms published on the Website at the time that Order is placed.
1.4. The following terms and policies also apply and should be read together with these Terms:
a) our Privacy Policy;
b) our Returns Policy;
c) our Shipping Policy;
d) our Warranty information;
e) our Promotions Terms and Conditions, for specific promotions and offers; and
f) our Competitions Terms and Conditions, for competitions and giveaways.
1.5. Nothing in these Terms is intended to limit the rights that You have under the Australian Consumer Law.
2. Definitions
2.1. We, Us, Our and OZtrail mean Adventure Trading Australia Pty Ltd ABN 77 010 916 006 trading as OZtrail Leisure Products.
2.2. You and Your mean a purchaser or prospective purchaser of Adventure Trading Australia Pty Ltd products specifically and solely through the website www.oztrail.com.au or directly and without intermediary with Adventure Trading Australia Pty Ltd. For the sake of clarity, it wholly excludes a person or company that purchases an Adventure Trading Australia Pty Ltd product through a third party.
2.3. Terms means this list of Terms and Conditions contained within, and known as the OZtrail Terms and Conditions.
2.4. Order means an offer to You to buy products on specific terms from Us.
2.5. Website means www.oztrail.com.au and the associated digital content to which it refers.
2.6. Account means a customer account registered by You on the Website.
2.7. Benefits mean discounts, discount codes and promotions on items available through the Website, and Promotional Activities means any promotion, offer or campaign run by Us through the Website.
2.8. Club Pricing and Club Price mean the OZtrail Club member pricing described in clause 9.
2.9. OZtrail Club member means a customer who holds an Account and is signed in to that Account when placing an Order.
3. Use of the Website
3.1. The Website is owned and operated by Adventure Trading Australia Pty Ltd. All rights are reserved.
3.2. Our Website is provided for the purpose of selling OZtrail products and services and providing related information about outdoor equipment. While we strive to ensure the accuracy of the information presented, we do not warrant that it is free from error and reserve the right to correct inaccuracies when identified.
3.3. All content on the Website, including text, images, videos, logos, trade marks and product designs, is owned by or licensed to Us. You must not copy, reproduce, publish or use any of that content for a commercial purpose without Our prior written consent.
3.4. You must not use the Website for any unlawful purpose, interfere with its security or operation, use automated tools to access or extract data from it, or attempt to obtain products, prices or Benefits by fraud or misrepresentation.
3.5. The Website may contain links to third party websites. We are not responsible for the content, products or practices of those websites, and Your use of them is subject to their own terms.
4. Your Account
4.1. You may need an Account to access some features of the Website, including Club Pricing. You must provide accurate and complete information when registering and keep it up to date.
4.2. You are responsible for keeping access to Your Account secure, including access to the email address used to sign in, and for all activity under Your Account. Please contact Us immediately if You believe Your Account has been used without Your permission.
4.3. Each Account is for use by one individual only. We may suspend or close an Account, or cancel Orders placed through it, if We reasonably believe it has been used in breach of these Terms, including to obtain Club Pricing or Benefits in a way that is not permitted.
5. Placing Your Order
5.1. You warrant to Us that the products purchased under this agreement are for personal use only and will not be used in a commercial act, or on-sold for a commercial purpose.
5.2. If you place multiple consecutive Orders from Us through this Website or another method, there is no guarantee of consolidation of your Orders.
5.3. Due to the nature of our products, we cannot deliver to, and do not accept delivery addresses that are, a PO Box, Private Mail Bag, Couriers Depot or Parcel Locker.
5.4. The order confirmation email We send You confirms that We have received Your Order. It does not mean Your Order has been accepted. Your Order is accepted when We dispatch the products to You.
5.5. We may limit the quantity of any product that can be purchased per customer, per household or per Order, and We may refuse or cancel any Order that We reasonably believe is for resale, is fraudulent, or breaches these Terms. If We cancel an Order after payment, We will refund the amount paid.
6. Product Information and Availability
6.1. Some products may be unavailable from time to time. We will use our best endeavours to keep the Website up to date with availability information. However, should You order a product that is out of stock you will be refunded as soon as is practicable.
6.2. We may from time to time withdraw products from sale at our sole discretion, provided these products are not part of a current promotion. This may be temporary or permanent.
6.3. We take all reasonable precautions and exercise due diligence to avoid any failures in our Website that may affect your Order, however these can still occur from time to time.
6.4. We reserve the right to not honour incorrect offers placed on the Website made by genuine error of system or operator caused directly or indirectly by Us. If your Order is identified as being affected by an error, you will have the affected portion of your Order refunded immediately if we cannot provide the product or a replacement product to you.
6.5. We make every effort to display product colours, images and descriptions accurately. Colours may appear differently depending on Your screen, and dimensions and weights are approximate. Lifestyle images may show accessories or items that are sold separately.
7. Pricing and Payments
7.1. Upon placement of your Order we will charge you and you agree to pay the pricing as presented to you at the time of ordering.
7.2. All prices unless specified otherwise are inclusive of Goods and Services Tax (GST) and will include the appropriate rate as it may be set.
7.3. All prices are denominated in Australian Dollars unless specified otherwise.
7.4. We reserve the right to change or alter prices without notice. If you have already submitted an Order at a set price, your products will be supplied at that price unless a genuine error exists in the system within the meaning of clause 6.4.
7.5. Payment will only be accepted by way of Visa, Mastercard, American Express, Shop Pay, PayPal, Google Pay, Apple Pay, Afterpay and Zip, or such other payment methods as are displayed at checkout at the time of your Order. Payment methods offered may change from time to time and some payment methods may be subject to the separate terms and conditions of the payment provider.
7.6. Payments must be cleared for an Order to be submitted by You.
7.7. By making payment to Us You warrant that you are not doing so fraudulently.
8. Discount Codes, Benefits and Promotions
8.1. A price incentive or discount offered by the Website creates no requirement for a third party to offer the same or similar.
8.2. The following terms apply to all Benefits and Promotional Activities:
a) Eligibility: Benefits are offered to Australian residents aged 18 or older.
b) Usage: One Benefit per transaction unless otherwise stated. Benefits must be redeemed at the point of sale and cannot be applied retrospectively.
c) Non-Transferable: Benefits cannot be sold, transferred, or redeemed for cash or any other instrument, including gift vouchers, gift cards, cheques, or credit notes.
d) Amendments: OZtrail reserves the right to vary, withdraw, or cancel Benefits and Promotional Activities at any time without notice.
e) Expiry: Benefits have an expiry date, after which they become invalid. OZtrail reserves the right to change expiry dates without notice.
f) Liability: OZtrail is not liable for any technical failures or issues beyond our control that prevent the redemption of Benefits.
8.3. Sign-Up Discounts: Valid for first-time purchases only. Codes are single-use, non-transferable, and expire after a set period.
8.4. Campaign Period Exclusions: From time to time, OZtrail may run major campaign or sale events during which previously issued discount codes, offers, or benefits (including, but not limited to, sign-up codes, loyalty rewards, affiliate codes, or partner offers) will be temporarily suspended or rendered invalid. During these designated campaign periods, only active sale prices and promotions advertised on oztrail.com.au will apply.
8.5. OZtrail reserves the right to:
a) deactivate or invalidate discount codes at any time without notice;
b) exclude specific product categories or sitewide promotions from code redemption; and
c) prevent the stacking or combination of discounts.
8.6. Discount codes will automatically resume eligibility once the campaign period has concluded, unless otherwise stated.
8.7. All discount codes, promotional codes and other offers are subject to clause 9 (OZtrail Club Pricing).
8.8. Specific promotions and competitions may be subject to additional terms, published in our Promotions Terms and Conditions and Competitions Terms and Conditions, or as stated in the promotion or competition itself.
9. OZtrail Club Pricing
9.1. OZtrail Club Pricing is an exclusive price available to OZtrail Club members on selected products. To receive Club Pricing, You must be an OZtrail Club member at the time of placing Your Order. Products with Club Pricing are identified on the Website.
9.2. Club Pricing is only available on selected products. Not all products are eligible for Club Pricing.
9.3. Club Pricing is only available on purchases made online through the Website, www.oztrail.com.au. Club Pricing is not available through, and cannot in any way be redeemed, claimed or price-matched at, any other retailer or stockist of OZtrail products, whether online or in-store. Club Pricing may not be displayed or applied when ordering through third party apps, including the Shop app.
9.4. We may change, withdraw or end Club Pricing at any time without notice. This includes which products are eligible and the Club Price of any product. Any Order already placed will be supplied at the price shown at the time of ordering, in line with clause 7.4.
9.5. Club Pricing cannot be combined with any discount code. If Your Order contains one or more products with Club Pricing applied, no discount code, promotional code, voucher code or coupon code can be applied to any part of that Order. This applies to the entire Order, including any products in the same Order that do not have Club Pricing.
9.6. Orders that do not contain any product with Club Pricing applied can still use any qualifying discount code, subject to the terms of that code.
9.7. To use a discount code on products without Club Pricing, You must buy those products in a separate Order that does not contain any Club Pricing products.
10. Specific Promotional Offers
10.1. Free Gifts: Available only with qualifying purchases. If the qualifying item is returned, the value of the free gift will be deducted from the refund if not returned in its original, unused condition. Free gifts are added automatically to the cart for eligible products. It is the customer's responsibility to ensure the free gift remains visible in the cart before completing checkout. If the free gift is removed or does not appear at checkout, the order will be processed without the free gift and a secondary shipment will not be provided. Free gifts apply only to purchases made directly on oztrail.com.au and are not available when ordering through the Shop App.
10.2. Product Bundles: Discounts apply only when items are purchased together. Returns of individual items may void the discount.
10.3. Add-On Savings: Applicable only when the add-on item is purchased with a qualifying item. If the qualifying item is returned, the add-on discount is removed.
10.4. Build Your Own Bundle: Discounts apply when purchasing the minimum number of eligible items. Returns may void the discount.
10.5. Product Volume Discounts: Only valid when the minimum quantity is purchased. Partial returns may void the discount.
10.6. Free Shipping Offers: If returned items reduce the order total below the free shipping threshold, shipping costs will be deducted from the refund.
10.7. Buy X Get Y Promotions: One free item per customer per order. If the qualifying item is returned, the free item must also be returned or its value will be deducted.
10.8. Discount Bundles: Discounts apply only when all specified items are purchased together. Partial returns void the discount.
11. Gift Cards
11.1. OZtrail gift cards can only be redeemed on the Website and cannot be used at any other retailer or stockist of OZtrail products.
11.2. Gift cards are valid for the period stated on the gift card, which will be no less than three years from the date of purchase.
11.3. Gift cards cannot be redeemed for cash, reloaded or replaced if lost or stolen, except as required by law. Any unused balance remains on the gift card until it expires.
12. Delivery and Risk
12.1. Risk and title to goods passes upon the date and time of delivery to You, Your nominated delivery location or Your nominated agent.
12.2. Delivery times shown on the Website are estimates only. Delivery details, costs and timeframes are set out in our Shipping Policy.
13. Returns and Cancelled Orders
13.1. Unless provided for in writing by Us to You or as otherwise allowed for under these Terms, no cancellations of Orders shall be allowed unless the product is subject to a failed consumer guarantee. 13.2. If your Order cannot be completed You may be contacted by Us to facilitate a resolution. If we cannot issue you a replacement product or the failure is irreparable, we may at our discretion cancel your Order and issue you with a refund of any monies paid as soon as is practicable.
13.3. If you are planning on returning a product, to resolve the return as expeditiously as possible, we require you to contact our customer service team at info@adventureoperations.com first. Unplanned or unidentified deliveries to our distribution centres or retail outlets may be rejected. If you return a product and our distribution centre has rejected it, please contact our customer care team.
13.4. If you would like to organise a return of a product for whatever reason you must contact our customer service team.
13.5. Forfeiture of Benefits: Any applied Benefits are forfeited if the qualifying item is returned.
13.6. Refund Adjustments: If promotional items (e.g., free gifts) are not returned, their value is deducted from the refund.
13.7. Exchanges for Lesser Value: Benefits will not transfer, and the price difference will not be refunded.
13.8. Bundle Returns: All items in a bundle must be returned together for a full refund. Partial returns may void the discount.
14. Consumer Guarantees, Warranties and Repairs
14.1. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
14.2. Additional warranties may be provided to those accrued by operation of the Australian Consumer Law. The terms and conditions of each will be noted on the product and its packaging.
14.3. Please note that we have very limited repair facilities for our products. This means that subject to any limited repair facilities offered through authorised repair agents, we are not able to repair broken or damaged products that are broken or damaged by you or are defective. For defective products, this Limited Warranty and your rights under the Australian Consumer Law will apply and in most cases the remedy will be limited to a refund or replacement.
14.4. OZtrail carries spare parts for many, but not all, of our products. A comprehensive catalogue of our spare parts can be found at: Spare Parts page. This means that where a product is broken or damaged by you, we may not be able to provide you with a spare part for that product. Where a product is defective, you will be entitled to your rights under our Limited Warranty and the Australian Consumer Law, and in most cases the remedy will be limited to a refund or replacement.
15. Product Recalls
15.1. If a product is subject to a product recall, notices will be posted in an appropriate section of the Website or on our social media platforms. The affected products may be returned should such a circumstance exist.
16. Reviews and User Content
16.1. If You submit a product review, rating, photo, video or other content to Us (User Content), You confirm that it is Your own genuine experience, that You own or have the right to share it, and that it is not false, misleading, offensive or unlawful.
16.2. You grant Us a non-exclusive, royalty-free, perpetual licence to use, reproduce, display and publish Your User Content on the Website, in Our marketing and on Our social media channels, and to identify You by the name You provided with it.
16.3. We may moderate, decline to publish or remove User Content that breaches these Terms.
17. Limitation of Liability
17.1. Nothing in these Terms excludes or limits your rights under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law or similar State or Territory legislation that cannot be excluded, restricted, or modified.
17.2. We exclude to the extent allowed under Law all implied terms and warranties relating to the subject matter of these Terms.
17.3. To the maximum extent permitted by law, our liability for loss and damage of any kind to You is limited to the value paid by you to us for the product, or otherwise in the case of goods or services:
a) the replacement of the goods or the supply of equivalent goods or services; or
b) the payment of the cost of replacing the goods or of acquiring or supplying equivalent goods or services.
17.4. OZtrail is not liable for indirect, incidental, special, or consequential losses or damages, including but not limited to:
a) inability to access or use the Website or any material on the Website;
b) unauthorised access to or alterations of your transmissions or data; and
c) statements or conduct of any third party on the Website.
17.5. You warrant to Us that you hold Adventure Trading Australia Pty Ltd harmless for loss or claim related to indirect or consequential loss.
17.6. We are not liable for any delay or failure to perform Our obligations caused by events beyond Our reasonable control, including natural disasters, extreme weather, carrier or supplier delays, industrial action or pandemics.
18. Privacy and Communications
18.1. Personal information that is provided by You to Us will be kept, used, disclosed or disposed of in accordance with the Adventure Operations Group Privacy Policy available at Privacy Policy or the Privacy Act 1988 as it may apply.
18.2. By using this Website, you accept OZtrail's Privacy Policy. We are not liable for any misdirected, lost, or undelivered communications due to technical issues, including but not limited to network failures or software malfunctions.
18.3. If You subscribe to Our marketing emails or SMS, You can unsubscribe at any time using the link or instructions in any message. We will still send You service messages about Your Orders and Account. Our SMS terms are set out in clause 19.
19. SMS and Mobile Messages
19.1. The OZtrail mobile message service (SMS Service) is operated by Adventure Trading Australia Pty Ltd ABN 77 010 916 006 trading as OZtrail Leisure Products. By opting in to the SMS Service, You agree to this clause 19. We may modify or cancel the SMS Service or any of its features at any time.
19.2. By opting in, You consent to receive recurring SMS and MMS messages from and on behalf of OZtrail at the mobile number You provide. Messages may include service messages, such as order, delivery and account updates, and promotional messages, such as offers, new products and reminders about items left in Your cart.
19.3. Signing up to the SMS Service is optional and is not a condition of any purchase.
19.4. We do not charge for the SMS Service, but standard message and data charges from Your mobile provider may apply. Message frequency varies.
19.5. You can opt out of promotional messages at any time by replying STOP to any message (where replies are supported) or by using the unsubscribe link included in our messages. We will confirm Your opt-out and action it within 5 working days, in line with the Spam Act 2003 (Cth). Opting out of promotional messages does not stop service messages about Your Orders. 19.6. We may change the number or sender name We use to send messages. Messages You send to a number We no longer use may not be received, and We will not be responsible for acting on them.
19.7. You must provide a valid mobile number that You own or are authorised to use. If You change Your mobile number, You will need to sign up again with Your new number.
19.8. Mobile carriers are not liable for delayed or undelivered messages. Subject to clause 17.1, We are not liable for failed, delayed or misdirected delivery of any message, any errors in a message, or any action You take or do not take in reliance on a message.

20. Termination
20.1. Either party may terminate any agreement under these Terms upon notification to the other party if the other party has committed a material breach of these Terms.
21. General and Savings
21.1. If any part of these Terms is unenforceable at Law it will be read down to a point where such is possible, or severed from the Terms.
21.2. The Law of Queensland, Australia governs this agreement, and your transaction is agreed between You and Us to have occurred at Eagle Farm in the state of Queensland. Disputes will be handled under the jurisdiction of Queensland courts.
21.3. Any failure or election to not enforce a right or power accrued by Law or this agreement under these Terms by Us does not constitute a waiver of such right or exercise of power, or the exercise of such a right or power on future occasions.
21.4. This agreement includes all promotional terms published on the Website. In case of discrepancies, OZtrail's decision is final and binding.
22. Privity of Terms
22.1. This agreement does not apply to a person or company that does not transact in contract directly with Us for end-user consumption within the contemplation of clause 5.1.
22.2. This agreement does not apply to a person or company that transacts with a third party for the supply of Our product. Such transactions will be subject to the terms and conditions as offered and applied by the third party.
22.3. Nothing in this clause 22 is intended to limit the rights You have under the Australian Consumer Law.
